A. U.S. State Privacy Laws

This U.S. Supplemental Privacy Notice (“Supplemental Notice”) provides the disclosures required under the state laws of California, Colorado, Connecticut, Montana, Oregon, Texas, Utah, and Virginia (collectively, “U.S. State Privacy Laws”). . Unless otherwise defined in this Supplemental Notice or Grizzly’s general privacy policy linked HERE (“Privacy Policy”), any terms defined in U.S. State Privacy Laws have the same meaning when used in this Supplemental Notice. This Supplemental Notice supplements the Privacy Policy, and applies solely to information collected about California, Colorado, Connecticut, Montana, Oregon, Texas, Utah and Virginia consumers.

B. What Information Do We Collect?

We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information”). The following table provides the categories of personal information we may collect from consumers, the sources from which they may be collected, the purposes for which it is collected or disclosed and the categories of third parties who we may disclose such information to.

Grizzly does not collect sensitive data as defined under the Colorado, Connecticut, Montana, Oregon, Texas, Utah or Virginia law.

The only “sensitive personal information”, as defined by the California Privacy Rights Act of 2020 (“CPRA”), Grizzly collects is account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account. This information is collected from individual customers, third-party service providers and financial information may also be obtained from third-party services such as Facebook or Amazon Payments account information, purchase or redemption information.

We use this Sensitive Personal Information:

To process requests, purchases, transactions, to collect payments, to facilitate payments and transactions, and to prevent transactional fraud;
To customize future customer interactions;
To correct our records and provide technical services;
In cases of corporate transactions such as divestitures, mergers, consolidations, acquisitions, asset sales or in the unlikely event of bankruptcy;
As we believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities; (iv) to enforce this Supplemental Notice, our Privacy Policy and the Grizzly Terms & Conditions; (v) to protect our operations or those of any of our subsidiaries and/or affiliates; (vi) to protect our rights, privacy, safety or property, and/or that of our affiliates and/or subsidiaries, you, or others; and (vii) to allow us to pursue available remedies or limit the damages that we may sustain.

Such information may be disclosed to third-party service providers, such as payment processors, debt servicing and collection agencies, purchasers of Grizzly stores, subsidiaries, or business units, third-party businesses for whom Grizzly is a reseller of their products when a customer has bought such a product and law enforcement agencies, courts, governmental / regulatory authorities.

The CPRA provides California consumers with the right to limit use of your sensitive personal information (1) to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services; (2) for certain business purposes; and (3) as authorized by the implementing regulations of the CPRA. However, please note that Grizzly does not use or disclose your sensitive personal information for any purpose other than those permitted under the CPRA.

Grizzly will retain the personal information set forth in the table above and sensitive personal information described above for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable laws or regulation.

You can opt out of Google Analytics and customer the Google Display Network ads by visiting the Google Ads Settings page and installing the Google Analytics Opt-out Browser Add-on from each browser on each device. If you replace, change, or upgrade your browser, or delete your cookies, you may need to use these opt-out tools again. We do not monitor or follow “Do Not Track” (DNT) signals because there is no standard interpretation or practice for DNT signals. Therefore, we handle all user information consistent with this Privacy Policy. Please visit your mobile device manufacture’s website, or the website for its operating system, for instructions on any additional privacy controls in your mobile operating system, such as privacy settings or device identifiers and geolocations.

As set forth in the table above, Grizzly may disclose your personal identifiers (like IP addresses), Internet or other electronic network activity information geolocation data, and commercial information to website analytics and digital advertising service providers. This may constitute a “sale” and is considered “sharing” under the CPRA and processing for purposes of targeted advertising under the other U.S. State Privacy Laws.

C. Right to Know

California, Colorado, Connecticut, Montana, Oregon, Texas, Utah, Virginia consumers have the right to request that we confirm whether we are processing your personal information and to access such information. You may submit a request to know by following the process outlined in Section G below.

D. Right to Delete

California, Colorado, Connecticut, Montana, Oregon, Texas, Utah, Virginia consumers have the right to request deletion of the personal information we have collected from them. You may submit a request to delete by following the process outlined in Section G below.

Except to the extent we may deny your request, we shall otherwise retrieve and delete any personal information we have collected about you. We shall also reach out to any third-party service providers with whom we may have disclosed your personal information to request deletion and confirmation of the same.

E. Right to Correct

California, Colorado, Connecticut, Montana, Oregon, Texas, Virginia consumers have the right to request that we correct inaccuracies in your personal information, taking into account the nature of the personal information and the purposes of the processing of your personal information. You may submit a request to delete by following the process outlined in Section G below.

F. Right to Opt Out

California consumers have the right to opt out of the selling or sharing of personal information. Colorado, Connecticut, Montana, Oregon, Texas, Virginia consumers have the right to request to opt out of the processing of personal information for purposes of:

Targeted advertising;
The sale of personal information; or
For Colorado, Connecticut, Montana, Oregon and Texas residents, profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. We do not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.

G. Submitting a Request

You can submit a request exercising the rights applicable to you under the applicable U.S. State Privacy Law by clicking HERE or by calling us at 1-888-585-9724. You will need to provide us with personal information to verify your identity and residency. The personal information that we use for verification will not be used for any other purposes. To submit a request, we may ask you to provide one or more of the following pieces of information:

Name, address, and phone number
Your last order number, if you have ordered products from us
Email address that matches the email on our file.

Once we receive your consumer request and verification information, we will send you an acknowledgement letter. We will respond to your request within 45 days if we are able to verify your identity. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Submitting Requests via an Authorized Agent. Only you or a person you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. If anyone purporting to be an authorized agent for a consumer contacts us, we will require proof that the authorized agent has been authorized to act on the consumer’s behalf. In particular, when a California or Connecticut consumer authorizes an agent to make a request on their behalf, we may require the agent to provide proof of signed permission from the consumer to submit the request, or we may require the consumer to verify their own identity to us or confirm with us that they provided the agent with permission to submit the request.

H. Appeals

In the event we deny your request, you may appeal our denial by contacting us in the same manner by which you submitted your request. Please provide a copy of or otherwise specifically reference our decision on your consumer request, so that we may adequately address your appeal. We will respond to your appeal in accordance with applicable law.

I. Your Right to Non-Discrimination for the Exercise of a Privacy Right.

We will not discriminate against you for exercising any of your rights under applicable U.S. State Privacy Laws. Unless permitted by applicable U.S. State Privacy Laws, we will not:

Deny you goods or services.
Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
Provide you a different level or quality of goods or services.
Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by applicable U.S. State Privacy Laws that can result in different prices, rates, or quality levels. Any U.S. State Privacy Law-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

J. Other California Privacy Rights

California’s “Shine the Light” law (Civ. Code § 1798.83) permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. We may email you to notify you of any material changes to our Privacy Policy and Grizzly Terms & Conditions, but you should check our Website frequently to see recent changes. Unless stated otherwise, our current Supplemental Notice and Privacy Policy applies to all information that we have about you and your account. Your continued use of the Website following the posting of changes constitutes your acceptance of such changes.

How do I receive freight deliveries?
We often receive questions concerning how freight deliveries work. We have done our best to provide insight to these common concerns.

Common questions about our freight policy to get your shipments safe and sound.

Liftgate service and freight policy: A full-size tractor-trailer must safely park at your curb and will not be able to park on a busy road or highway. Your road cannot be a private driveway, cul-de-sac, dead end or unpaved. The carrier will not pull into your driveway, nor back down your street.

We estimate, but cannot guarantee, that freight shipments may take up to 4-6 business days for delivery. If you are tracking your order on the carrier's website, ignore any estimated delivery dates as these are often incorrect. If the carrier considers your address to be rural, it could take an additional week for delivery depending on how often they deliver in your area.

The carrier will call to make an appointment for residential deliveries, usually at least a day in advance. They deliver during regular business hours. Please make sure to provide the best phone number to reach you when placing your order to prevent your order from being delayed or returned to us.

Once the carrier arrives you will be responsible for unloading the freight if there is no loading dock. If you cannot unload, liftgate delivery is available for $34.00. With liftgate, the carrier will either assist with hand offloading or employ the use of a traditional hydraulic lift. You will still be responsible for moving the freight from the curbside to your shop or garage once it is off the truck. There is an option to add liftgate service if you place your order online.

You may also choose to pick up your freight from the carrier's local terminal. They will load it onto your vehicle. Please make sure your vehicle is capable of handling the weight and bring plenty of tie downs to properly secure the load.

It is extremely important that you write any box damage, no matter how minor, on the delivery receipt in case we need to replace the machine. This includes any dents, scuffs, tears, holes or if the original packaging appears to have been modified. It is also vital to verify the number of boxes received and write any shortages on the delivery receipt. If there is anything damaged, missing and/or repackaged make sure to take photos and keep all packaging in case it needs to be shipped back. You will also need to call us to report the damage and we will work to resolve the issue for you as quickly as possible.
What does Grizzly charge for shipping?
Grizzly offers free standard shipping on most non-freight items for qualifying orders of $50 or more to any location within the contiguous 48 US States. Free shipping does not apply to items designated as "special shipping."

Items designated as "special shipping" have flat-rate shipping and handling charges per item that are assessed by the weight and size of the item. We are unable to waive or alter these charges to help keep our prices as low as possible and stay competitive for our customers.

Purchases of qualifying non-freight items ordered at the same time as freight items will not be charged the additional small shipping charge (see chart below). We encourage everyone to take advantage of free shipping on qualifying accessories and consumables when ordering.

For deliveries to Alaska, Hawaii, Puerto Rico, and other US Territories for non-freight items, we use UPS or USPS, and additional shipping and handling charges will apply.
- We provide a shipping quote for all freight and oversize deliveries to Alaska, Hawaii, Puerto Rico, and other US Territories.
- Please note that we do not ship freight to US territories other than Puerto Rico, but we can ship to the address of a mainland freight forwarder of your choice.
- Select non-freight items that are considered special shipping due to the size or weight of their package must be shipped separately from other non-freight items and do not qualify for free shipping.

How are returns processed when they are received back into your warehouse?
Once your return shipment is received in our warehouse, it takes approximately two to three business days for our staff to inspect the product and set up your replacement order or refund. It can take slightly longer during extremely busy times.

If we are repairing the item you returned, additional time will be required to order replacement parts and make repairs. If you originally paid for the item using a credit card, PayPal, PayPal Credit or Amazon Payments, we will credit your original form of payment. We will issue a refund check for items originally paid for by check, money order or bank wire transfer. If we reimburse your return shipping costs, we will do so in the form of a refund check. We may also issue a Gift Certificate for store credit in some circumstances.

All defective and non-defective returns must be in original packaging, unused and in resalable condition and are subject to a 10% restocking fee when applicable. Original shipping and handling charges are not refundable. Return shipping and handling charges will be deducted from the refund.

How do I report freight damage?
We know the importance of receiving your orders in good condition, and we strive to ensure that all of our small parcel packages and freight are delivered to you in perfect condition. However, we understand that sometimes damages may occur during transit.

Inspection upon receipt

When you receive your delivery, please thoroughly inspect all of the freight for any signs of damage to the packaging or the item itself. If you notice any damages, please make note of the condition on the delivery receipt before signing for the shipment.

Reporting Damages

If your order does arrive damaged, please keep all the original packaging and contact us immediately by clicking HERE. This will direct you to our ticket form where you can provide the necessary information and submit your request. Please make sure you provide your order number when submitting your request. You may also report damage by calling our CONTACT CENTER. We will work with you to resolve the issue as soon as possible.

Resolving Damages

We sincerely regret any inconvenience caused by the damages and we will work with you to find a solution as quickly as possible. Limited Warranty
Grizzly warrants every "Grizzly" branded product we sell for a period of 1 year to the original purchaser from the date of purchase/shipment. Grizzly warrants every "Shop Fox" branded product we sell for a period of 2 years to the original purchaser from the date of purchase/shipment. South Bend warrants every "South Bend" branded product we sell for a period of 2 years to the original purchaser from the date of purchase/shipment. This warranty does not cover defects due directly or indirectly to misuse, abuse, negligence, accidents, repairs, improper wiring, alterations, lack of maintenance or consumable parts.

This warranty is the only written warranty provided, and any implied warranties, including merchantability or fitness for a particular purpose, are limited to the duration of this written warranty. We want to clarify that our merchandise may not comply with the provisions of all laws, acts, or electrical codes. Additionally, we do not reimburse for third-party repairs, services, or any expenses related to transporting machinery to and from carrier vehicles or residences. Our liability under this warranty is capped at the purchase price of the product. Any legal actions against Grizzly Industrial will be tried in the State of Washington, County of Whatcom. We are not liable for death, injuries to persons or property, or incidental, contingent, special, or consequential damages arising from the use of our products.

To make a warranty claim, simply contact our CONTACT CENTER. Proof of purchase must accompany the merchandise. We value continuous improvements and our manufacturers reserve the right to change machine specifications at any time in an effort to provide even better quality equipment.
