U.S. State Privacy Laws
This U.S. Supplemental Privacy Notice (“Supplemental Notice”) provides the disclosures required under the state laws of California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, and Virginia (collectively, “U.S. State Privacy Laws”). Unless otherwise defined in this Supplemental Notice or Grizzly’s general privacy policy linked HERE (“Privacy Policy”), any terms defined in U.S. State Privacy Laws have the same meaning when used in this Supplemental Notice. This Supplemental Notice supplements the Privacy Policy, and applies solely to information collected about California, Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah and Virginia consumers. -
What Information Do We Collect?
The following table lists the categories of personal information we may collect about consumers, the sources from which we may collect that personal information, the purposes for which the personal information is collected or disclosed and the categories of third parties to which we may disclose such personal information.

Grizzly does not collect sensitive data as defined under the Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, Oregon, Tennessee, Texas, Utah or Virginia law.
Grizzly collects account log-in, financial account, and payment card information, which may be “sensitive personal information” or “sensitive data” or, as defined by the California Privacy Rights Act of 2020 (“CPRA”) and the New Jersey Data Privacy Act, respectively, . This information is collected from individual customers, third-party service providers and financial information may also be obtained from third-party services such as Facebook or Amazon Payments account information, purchase or redemption information.
We use this sensitive personal information or sensitive data:
- To provide access to customer accounts;
- To process requests, purchases, transactions, to collect payments, to facilitate payments and transactions, and to prevent transactional fraud;
- To customize future customer interactions;
- To correct our records and provide technical services;
- As we believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities; (iv) to enforce this Supplemental Notice, our Privacy Policy and the Grizzly Terms & Conditions; (v) to protect our operations or those of any of our subsidiaries and/or affiliates; (vi) to protect our rights, privacy, safety or property, and/or that of our affiliates and/or subsidiaries, you, or others; and (vii) to allow us to pursue available remedies or limit the damages that we may sustain.
Such information may be disclosed to third-party service providers, such as payment processors, debt servicing and collection agencies, purchasers of Grizzly stores, subsidiaries, or business units, third-party businesses for whom Grizzly is a reseller of their products when a customer has bought such a product and law enforcement agencies, courts, governmental / regulatory authorities. We may also disclose such information as part of, or in preparation for, corporate transactions such as divestitures, mergers, consolidations, acquisitions, and asset sales, or in the unlikely event of bankruptcy.
The CPRA provides California consumers with the right to limit use of your sensitive personal information (1) to that use which is necessary to perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services; (2) for certain business purposes; and (3) as authorized by the implementing regulations of the CPRA. However, please note that Grizzly does not use or disclose your sensitive personal information for any purpose other than those permitted under the CPRA.
Grizzly will retain personal information for as long as necessary to fulfill the purpose for which it was collected, or as required by applicable laws or regulation.
As described in the table above, Grizzly may disclose your personal identifiers (like IP addresses), Internet or other electronic network activity information geolocation data, and commercial information to website analytics and digital advertising service providers. This may constitute a “sale” and is considered “sharing” under the CPRA and processing for purposes of targeted advertising under the other U.S. State Privacy Laws. We disclose this information for the following purposes:
- To provide information about our services online, and to create, maintain, customize, and secure your account with us;
- To determine how many unique visitors our Website receives, locate the approximate geographic regions of our Website visitors, and identify returning visitors;
- To personalize your Website experience and to deliver content and product and service offerings relevant to your interest, including targeted offers and ads through our Website, third party sites, and via email or text message (with your consent, where required by law);
- To correct our records and provide technical, fulfillment, advertising, or other services to co-branded businesses;
- To provide, support, personalize, and develop our Website, products, and services;
- To process your requests, purchases, transactions, and payments and prevent transactional fraud;
- As we believe to be necessary or appropriate: (i) under applicable law; (ii) to comply with legal process; (iii) to respond to requests from public and government authorities; (iv) to enforce this Supplemental Notice, our Privacy Policy and the Grizzly Terms & Conditions; (v) to protect our operations or those of any of our subsidiaries and/or affiliates; (vi) to protect our rights, privacy, safety or property, and/or that of our affiliates and/or subsidiaries, you, or others; and (vii) to allow us to pursue available remedies or limit the damages that we may sustain.
We do not knowingly sell, share or process for purposes of targeted advertising the personal information of children under 18 years of age.

Consumer Rights.
Right to Know
Under U.S. State Privacy Laws, consumers resident in those states have the right to request that we confirm whether we are processing your personal information and to access such information. For our Maryland and Minnesota consumers, this includes a list of the specific third parties to whom we have disclosed your personal information, or if we do not maintain such information in a format specific to you, the third parties to whom we have disclosed personal information generally. Consumers also have the right to request a copy of your personal information we process, in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance. You may submit a request to know or access data by following the process outlined in Section D below.
Right to Delete
California, Iowa and Utah consumers have the right to request deletion of the personal information we have collected from them. Colorado, Connecticut, Delaware, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas and Virginia consumers have the right to request deletion of the personal information we have obtained about them. You may submit a request to delete by following the process outlined in Section D below.
Except to the extent we may deny your request, we shall otherwise retrieve and delete any personal information we have collected about you. We shall also reach out to any third-party service providers with whom we may have disclosed your personal information to request deletion and confirmation of the same.

Right to Correct
California, Colorado, Connecticut, Delaware, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Virginia consumers have the right to request that we correct inaccuracies in their personal information, taking into account the nature of the personal information and the purposes of the processing the personal information. You may submit a request to delete by following the process outlined in Section D below. -
Right to Opt Out
California consumers have the right to opt out of the selling or sharing of personal information.
Colorado, Connecticut, Delaware, Iowa, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas, Utah, Virginia consumers have the right to request to opt out of the processing of personal information for purposes of:
Targeted advertising;
The sale of personal information; or
For Colorado, Connecticut, Delaware, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Tennessee, Texas and Virginia residents, profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. We do not engage in profiling in furtherance of decisions that produce legal or similarly significant effects concerning you.
You may submit a request to opt-out by following the process outlined in Section D below. Submitting a Rights Request.
You can submit a request to exercise your rights under the applicable U.S. State Privacy Law by clicking HERE or by calling us at 1-888-585-9724. You will need to provide us with personal information to verify your identity and residency for most requests. Consumers that are provided with the right to opt out of the sale, sharing or processing personal information for purposes of targeted advertising may submit requests by clicking “Do Not Sell or Share My Personal Information” without providing additional personal information to verify your identity. The personal information that we use for verification will not be used for any other purposes. To submit a request, we may ask you to provide one or more of the following pieces of information, depending upon the sensitivity of the request:
Name, address, and phone number
Your last order number, if you have ordered products from us
Email address that matches the email on our file.
Once we receive your consumer request and verification information, we will send you an acknowledgement letter. We will respond to your request within 45 days if we are able to verify your identity. We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Submitting Requests via an Authorized Agent. Only you or a person you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. If applicable, you may also make a verifiable consumer request on behalf of your minor child. If anyone purporting to be an authorized agent for a consumer contacts us, we will require proof that the authorized agent has been authorized to act on the consumer’s behalf.

Appeals
In the event we deny your request, you may appeal our denial by contacting us in the same manner by which you submitted your request. Please provide a copy of or otherwise specifically reference our decision on your consumer request, so that we may adequately address your appeal. We will respond to your appeal in accordance with applicable law. -
Your Right to Non-Discrimination for the Exercise of a Privacy Right.
We will not discriminate against you for exercising any of your rights under applicable U.S. State Privacy Laws. Unless permitted by applicable U.S. State Privacy Laws, we will not, for exercising any of your rights under applicable U.S. State Privacy Laws:
Deny you goods or services.
Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
Provide you a different level or quality of goods or services.
Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain financial incentives permitted by applicable U.S. State Privacy Laws that can result in different prices, rates, or quality levels. Any U.S. State Privacy Law-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

If you choose to visit the Website or engage with us, your visit/engagement and any dispute over privacy is subject to this U.S. Supplemental Notice, our Privacy Policy and the Grizzly Terms & Conditions, including limitations on damages and resolution of disputes. Our business changes constantly, and this Supplemental Notice, our Privacy Policy and the Grizzly Terms & Conditions are subject to change also. We may email you to notify you of any material changes to our Privacy Policy, this Supplemental Notice and Grizzly Terms & Conditions, but you should check our Website frequently to see recent changes. Unless stated otherwise, our current Supplemental Notice and Privacy Policy applies to all information that we have about you and your account. Your continued use of the Website following the posting of changes constitutes your acceptance of such changes. -
